None appears for the private opposite party despite service of notice. The petitioner is the wife of the opposite party and seeks transfer of the proceeding being Maintenance case no.120 of 2024 pending before the learned Judicial Magistrate, 1st Court, Barasat to the Court of the learned Chief Judicial Magistrate, Haldia, Purba Medinipur on the ground that though she was a resident of Barasat earlier she has been transferred to Tamralipto Government Medical College and Hospital, Tamluk, Purba Medinipur and has joined the said post on 7th April, 2026. She has two children aged about 8 and 6 years respectively and it is difficult for her to travel to Barasat regularly to attend the proceeding pending before Barasat Court. A Matrimonial Suit being no.74 of 2023 filed by the opposite party against the petitioner which was pending before Barasat Court has been transferred to the
2 Additional District Judge, Haldia, Purba Medinipur by a co-ordinate Bench of this Court in an application filed by the petitioner being CO 2151 of 2026 relying upon the authority in N.C.V. Aishwarya vs. A.S. Saravana Karthick Sha in Civil Appeal No.4894 of 2022 decided on 18th July,
2022. Having regard to the inconvenience of the petitioner in commuting from Haldia to Barasat to appear before the learned Court at Barasat, this Court is inclined to transfer the proceeding pending before Barasat Court to the Court of the learned Chief Judicial Magistrate, Haldia, Purba Medinipur. The revisional application is accordingly allowed. Maintenance case no.120 of 2024 pending before the learned Judicial Magistrate, 1st Court, Barasat be transferred to the Court of the learned Chief Judicial Magistrate, Haldia, Purba Medinipur for disposal. The learned Judicial Magistrate, 1st Court, Barasat is directed to transmit the case record alongwith relevant documents to the Court of the learned Chief Judicial Magistrate, Haldia, Purba Medinipur within ten days from the date of communication of this order. The learned Chief Judicial Magistrate, Haldia, Purba Medinipur shall either deal with the case himself or assign the same to any other learned Magistrate within his jurisdiction. 3 There shall, however, be no order as to costs.
