JUSTICE S VISHWAJITH SHETTY ORAL ORDER Learned counsel for the petitioner submits that there is no progress in the case before the Trial Court in SC No.85 of 2023, though, the petitioner is in custody from 25.04.2023 onwards. He submits that as on this date, only one charge-sheet witness has been examined. Therefore, having regard to the petitioner's period of incarceration, - 3 - HC-KAR CNR: KAHC010411512026 NC: 2026:KHC:43194 CRL.P No. 8743 of 2026 the petitioner's prayer for grant of regular bail may be considered. 2. Learned High Court Government Pleader and learned counsel for respondent No.2 submit that the petitioner had earlier approached this Court in Criminal Petition No.10714 of 2023, which was dismissed on merits by the Co-ordinate bench of this Court on 16.01.2024 with observations that CW2 to CW8 are the eyewitnesses to the incident. 3. Learned High Court Government Pleader submits that CW2 is now examined and the remaining eyewitnesses shall be examined before the Trial Court, if six months time is granted to the prosecution. 4. Learned counsel for the petitioner at this stage, submits that this petition may be dismissed as not pressed with liberty to the petitioner to renew his bail application immediately after examination of CW2 to CW8 is completed or after expiry of six months from the date of - 4 - HC-KAR CNR: KAHC010411512026 NC: 2026:KHC:43194 CRL.P No. 8743 of 2026 receipt of copy of this order by the Trial Court, whichever is earlier. 5.
