19.08.2026 Court No.35. D/L.48. Rakib (Rejected) CRM (M) 1040 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Dadpur Police Station case no. 31 of 2024 dated 11.02.2024 under Sections 302/201/120B/34 of the Indian Penal Code. And In the matter of : Sk. Sekandar Ali. ……Petitioner. Mr. Arka Ranjan Bhattacharya .....for the Petitioner. Mr. Rajendra Banerjee, Ld. APP Mr. Amal Kumar Datta ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for two years four months and only 14 witnesses out of 42 witnesses relied upon by the prosecution have been examined. Learned advocate appearing for the State has submitted a report, the same reflects that the case is progressing smoothly. Having considered the gravity of the offence, at this stage, I am not inclined to release the petitioner on bail. State would in the circumstances expedite the process, so that the trial can be taken to its logical conclusion. Accordingly, CRM (M) 1040 of 2026 is rejected. Memo of evidence submitted by the State be kept with the record. 2 All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
