Mr. Anup Dasgupta Mr. Rhitam Chatterjee …for the State. The Prescribed Authority is present in Court. Explanation submitted by the Prescribed Authority is taken on record. Ignorance of the Prescribed Authority about the provisions of an Act, which is dealt with by him every day, is extremely shocking. The explanation is far from satisfactory. This Court takes a serious note of the conduct of the Prescribed Authority which has in effect allowed the time frame laid down under Section 12(10) of the Act of 1973 to expire. The Prescribed Authority is directed to adhere to the provisions of law strictly henceforth and is warned not to repeat such conduct in future. 2 On merits, learned counsel for the petitioners submits that during pendency of the writ petition, a further notice has been issued by the Prescribed Authority fixing the date of meeting on 24th August, 2026. In view of the above, nothing further remains to be dealt with in the writ petition. The same is accordingly disposed of. Personal appearance of the Prescribed Authority is dispensed with. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
