Petitioner is aggrieved by the order of bail passed by learned Additional Chief Judicial Magistrate, Alipore which was passed on 13.12.2024. Learned advocate appearing for the petitioner submits that the genesis of the present case arose out of a matrimonial dispute. There were subsequent threats after the accused was granted bail and there has been misuse of the liberty granted to the accused/opposite party. Learned advocate appearing for the State has submitted a report which reflects that charge-sheet has been submitted before the jurisdictional court. So far as the issue relating to misuse of liberty is concerned, petitioner would better be advised to approach the jurisdictional court in seisin of the issue drawing attention to the relevant facts. The jurisdictional court will assess the genuinity of the accusations and after giving opportunity to the accused, decide the fate of the application.
2 At this stage, no interference is made by this Court. Report submitted by the learned advocate appearing for the State be kept with the record. With the aforesaid observations, the application for cancellation of bail being CRM (R) 102 of 2025 is disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
