ORAL ORDER
The petitioners are before this Court calling in question the proceedings in C.C.No.12985/2025, pending before the 50th Addl. Chief Judicial Magistrate, Bengaluru, registered for offences punishable under Sections 498-A, 323, 506 read with Section 34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. 2. Heard Sri.Seenappa, learned counsel appearing for the petitioners, Smt.Waheeda M.M., learned HCGP appearing for respondent No.1, Sri.B.R.Viswanath, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement in M.C.No.2796/2024 before the V Addl. Principal Judge, Family Court, Bengaluru and the said Memorandum of Settlement reads as follows:

"MEMORANDUM OF SETTLEMENT UNDER SECTION 89 OF CPC READ WITH RULES 24 AND 25 OF THE KARNATAKA CIVIL PROCEDURE (MEDIATION) RULES, 2005. The parties above named submit as follows:-
I. The petitioners have filed this joint petition under Section 13-B of the Hindu Marriage Act, 1955 for dissolution of their marriage with mutual consent. The Hon'ble Court has waived off the statutory waiting period of six months vide order dated 27.04.2024. II. The aforesaid petition was referred to mediation for resolving the dispute between the parties. In the course of mediation, the 1st petitioner and the 2nd petitioner along with their counsel are present, they have resolved their disputes and have agreed to the following terms and conditions:-
1. The petitioners state that their marriage was solemnized on 18.11.2022 at Apsara Conventional Hall, Annapoorneshwari Nagara, Bengaluru as per Hindu rites and customs. 2. The petitioners submit that they had differences between them and they are living separately from January 2023 and stopped cohabiting since then. Despite their best efforts, there is absolutely no chance of reunion amongst them. Hence, the petitioners have decided to get the marriage between themselves dissolved by a decree of divorce by mutual consent. 3. Both the parties state that they have no children born to them from the said marriage. 4. The 1st petitioner has agreed to pay a sum of Rs.
27,00,000/- (Rupees Twenty Seven Lakhs only) to the 2nd petitioner for all claims towards maintenance/permanent alimony as full and final settlement by way of demand draft bearing No. 546503 dated 18.04.2024 drawn on State Bank of India, Amruthahalli Branch, Bengaluru and the same shall be handed over to the 2nd petitioner at the time

of reporting settlement before the Hon'ble court. The 2nd petitioner agreed for the same. 5. Both the petitioners state that agree that, they have no claims over the movable or immovable properties belonging to each other either existing at present or to be acquired in future. 6. Both petitioners further state and agree that they have already exchanged their respective valuable articles and other personal belongings. 7. In view of the settlement agreement the 2nd petitioner has agreed to withdraw Cr.No.128/2023 same is pending before 39th Addl. C.M.M. Court filed against the 1st petitioner and also agreed to withdraw O.S.No.192/2023 pending before Principal Family Court, Bengaluru. Further the 1st petitioner has agreed to withdraw the M.C.No.3455/2023 pending before V Addl. Family Court, Bengaluru. 8. The petitioners further state that there has been no collusion or force, fraud or any undue influence in entering into this settlement agreement in the aforesaid manner. 9. Both the parties admit that they shall not interfere in the lives of each other in future. III. In view of the aforesaid agreement entered into between the parties, the parties pray that this Hon'ble Court be pleased to dissolve the marriage solemnized between the petitioners on 18.11.2022 at Apsara Conventional Hall, Annapoorneshwari Nagara, Bengaluru by granting a decree of Divorce in terms of the aforesaid agreement. This agreement shall be part of the decree. IV. Parties will appear on 28.05.2024 before the Hon'ble Court for passing orders in terms of the agreement."

In light of the settlement arrived at between the parties as afore-quoted, I pass the following:

ORDER [I] Criminal Petition is disposed.
[II] Proceedings in C.C.No.12985/2025, pending before the 50th Addl. Chief Judicial Magistrate, Bengaluru, stands quashed qua the petitioners.
