Learned advocate appearing for the petitioner submits that petitioner is in custody for about a year and although the subject matter of the present case relate to alleged recovery of 11.884 Kgs. of Ganja but from the possession of the present petitioner 5.9 Kgs. of Ganja were recovered.
Learned advocate for the Air Customs Authorities is present and opposes the prayer for bail.
It has been informed that complaint has already been submitted before the jurisdictional Court.
Having considered that the quantum of recovery is of intermediate quantity and relying upon Barnali Bag –Vs.-
2 Union of India [Special Leave Petition (Crl.) No. 3641 of 2026] I am inclined to release the petitioner on bail.
As such, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Mohammed Anis Shaikh shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, under NDPS Act, 8th Court, Barasat. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of North 24 Parganas without the prior permission of the learned Special Court.
Thus, CRM (NDPS) 1705 of 2026 is allowed.
