According to the petitioner, he made a representation to Regional Passport Officer for issuing a passport to him, but, no decision is being taken on that representation. Copy of the representation is enclosed as Annexure-3 to the writ petition, perusal thereof revels that an FIR under Section 302, 34 and 506 IPC was registered against the petitioner in Police Station Pathri, District Haridwar, in which petitioner was convicted and sentenced for life, however, in appeal the Uttarakhand High Court suspended the sentence and released the petitioner on bail. 5. Mr. Pankaj Chaturvedi, learned counsel appearing for respondent no. 2 submits that because of petitioner’s conviction, passport was not issued to him. 6. Learned counsel for the petitioner submits that petitioner’s conviction has not attained finality and appeal is still 2026:UHC:2703 pending and his sentence has been suspended, therefore, there is no reason not to issue passport to the petitioner. 7. Learned counsel appearing for respondent no. 2 submits that the representation enclosed with the writ petition does not bear any date. He submits that petitioner be permitted to make fresh representation. 8. The writ petition is, accordingly, disposed of by permitting petitioner to make fresh representation to the Regional Passport Officer within one week from today. It shall be open to him to make such representation, electronically. If he makes representation within stipulated time, decision thereupon shall be taken, within four weeks of its receipt.
