JUSTICE RAJESH KUMAR VERMA ORAL ORDER 3 22-04-2026 Heard Mr.Praveen Kumar Agrawal, learned counsel for the petitioner and Mr.Arun Kumar, learned A.P.P. for the State. 2. The petitioner seeks bail, who is in custody since 14.12.2025 in connection with Baisi P.S. Case No. 496 of 2025, F.I.R. dated 13.12.2025 registered for the offence punishable under Sections 8(c),21(b) of NDPS Act. 3. Recovery is of 105.24 Grams of Brown Sugar/Smack. 4. Learned counsel for the petitioner submits that the petitioner has clean antecedent. Further submits that it appears from the FIR as well as the seizure list that the contraband has been recovered from possession of co-accused person namely, Papai Ghosh and petitioner was apprehended alongwith co- Patna High Court CR. MISC. No.18270 of 2026(3) dt.22-04-2026 2/2 accused person, namely, Papai Ghosh and altogether 105.24 Grams of Brown Sugar/Smack like substance was recovered from possession of the petitioner. There is non-compliance of mandatory provisions of NDPS Act as well as the BNSS, 2023. 5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner and submits that altogether 105.24 Grams of Brown Sugar/Smack like substance was recovered from possession of co-accused person and petitioner was apprehended alongwith co-accused person, namely, Papai Ghosh and FSL report also confirms that, “6- Monoacetylmorphine (6-MAM)" was detected in the polythene packet marked as ‘Ext-1’ described above. "Monoacetylmorphine (6-MAM)" is highly addictive, intoxicating narcotic drug/substance.” 6. Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail in connection with Baisi P.S. Case No. 496 of 2025 pending in the court of learned Special Judge, NDPS Act, Purnea. 7. Prayer is refused. Nitesh/- (Rajesh Kumar Verma, J) U T
