The petitioner has filed the present petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 with a prayer to grant anticipatory bail to him in case FIR No.49 dated 18.06.2026, registered under Sections 326, 3(5) of BNS (corresponding Sections 430, 431, 432, 34 IPC) at Police Station City Ahmedgarh, District Malerkotla.

While granting the concession of interim anticipatory bail by this Court on 26.06.2026, the following contentions were noticed by this Court and the same have been reproduced below:-
“Learned counsel for the petitioners, inter alia, contends that a civil dispute is pending between the parties concerned. And, even if the allegations are assumed to be true, the same, at best, culminate into civil liability and do not attract the provisions of penal code, at all. Elaborating his submissions, he asserts that the petitioners had taken a cinema hall on lease from the complainant, and were regularly paying the lease amount.

However, owing to some business rifts, the petitioners instituted a civil suit seeking damages, for not providing the necessary documents, enabling them to operate the cinema.”

Learned counsel for the petitioner has reiterated the
submissions and further submits that the petitioner has joined the investigation and his custodial interrogation may not be required.

Learned State counsel, on instructions, submits that the petitioner has joined the investigation and is no longer required for further investigation.

In view of the statement made by learned counsel for the parties, the present petition is allowed and the interim order dated 26.06.2026, passed by this Court is made absolute. The petitioner shall continue to join investigation, as and when called by the Investigating Officer and shall also abide by the conditions as provided under Section 482(2) of the BNSS.

Pending application(s), if any, is/are disposed of.
