Mr. Debjit Mukherjee Mrs. Susmita Chatterjee Mr. Koustav Bhattacharya …for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for direction upon the learned Additional District Judge, 2nd Court, Howrah, to dispose of the Probate Suit No. 30 of 2022, expeditiously. From the order sheets appended to this application, this Court finds that that 19th September, 2026 is fixed for evidence of the defence witness. The order sheet further reflects that the Presiding Officer has been transferred and the learned Additional District Judge, 2nd Court, Howrah is in charge. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite parties. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned Advocate for the petitioners, this civil revisional application stands disposed of with a direction that after the regular Presiding Officer joins, the learned Additional District Judge, 2nd Court at Howrah shall take up the evidence of the 2 defence witness and shall make an endeavour to dispose of the Probate Suit No. 30 of 2022 as expeditiously as possible, preferably within a period of six months from the next date fixed after the regular Presiding Officer, joins. The learned Judge shall be free to reject any prayer for unnecessary adjournments to either of the parties. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities. (Hiranmay Bhattacharyya, J.)
