1. The writ application has been preferred being aggrieved by a show-cause notice dated 12.06.2026, asking the petitioner to show-cause as to why warrant of arrest shall not be issued. 2. On hearing the learned counsels for the parties and on perusal of the materials on record, it appears that the petitioner herein has filed an appeal before the appropriate forum being the learned Central Government Industrial Tribunal-cum-Labour Court, Kolkata on 25.02.2026. The said appeal has been numbered as 12/EPF/2026. There is a delay in filing the appeal. But the said delay is to be considered by the Tribunal before which the appeal is pending. 3. Admittedly, there is no regular Presiding Officer at the CGIT, Kolkata for which the petitioner could not make his prayer in respect of the show-cause dated

It appears that the show-cause notice has been issued on 12.06.2026 thought the appeal is pending before the CGIT, Kolkata for adjudication and the petitioner has been unable to obtain any interim relief from the Tribunal due to the vacancy there. 5. Considering the said facts, the writ application is disposed of with the direction that the respondent authorities shall not take any coercive action against the petitioner till 28th August, 2026, when the next date has been fixed before the Tribunal and/or till the matter is taken up by the learned Tribunal. The Tribunal shall be at liberty to decide the prayer of the petitioner for interim relief, in accordance with law. 6. Mr. Gupta, learned counsel for the RPF Authority has placed a copy of the ‘Viswas Scheme 2026’ floated by the EPF Organization and submits that the petitioner can avail of the benefit provided by the said Scheme. 7. Considering the said submission, the petitioner is at liberty to approach the authorities, if they intend to avail of the said Scheme in the interim period. 8. WPA 15102 of 2026 stands disposed of. 9. Connected application, if any, stands disposed of. 10.
