Heard learned counsel appearing for the respective parties. [2]
This present writ petition is filed under Article 226 of the Constitution of India seeking the following reliefs:
“i. Issue Notice upon the Respondents, ii. Call for the records, iii. Issue the Rule calling upon Respondents No. 4 & 5 to show cause as to why the Respondents shall not be directed to revise the Petitioner's consolidated fixed remuneration/honorarium for the period from 01.04.2021 to 31.12.2022, as per the order dated 28.01.2026 passed by the Under Secretary, Health & Family Welfare Department, Govt. of Tripura.
AND Issue Rule calling upon the Respondents to show cause as to why a writ of mandamus or any other appropriate writ shall not be issued directing the Respondents to release the arrears of pay for the period of re-engagement of the Petitioner as Lecturer (Selection Grade) Contractual basis in Regional Institute of Pharmaceutical Science on & Technology (RIPSAT), Agartala with effect from 1.4.2021 to 31.12.2022 upon revision of the same taking into account the revised pension of the Petitioner as per clause 2(ii) of the Finance Department Memorandum dated 29.08.2017 and the order dated 28.01.2026 passed by the Under Secretary, Health & Family Welfare Department, Govt. of Tripura. AND Issue Rule calling upon the Respondents to show cause as to why the salary of the Petitioner for the month of December, 2022 shall not be released. AND Issue Rule calling upon the Respondents to show cause as to why the Petitioner shall not be entitled to litigation cost of Rs. 1,00,000/- and interest @ 16% per annum on the total amount of arrears admissible to the Petitioner from the date the same fell due till date of actual payment.”

After perusal of the record, it has been seen that an order was passed on 28.01.2026 by the Under Secretary, Govt. of Tripura, wherein it is stated that respondent Nos.4 and 5 shall comply the order in connection with the grievance of the petitioner herein, but till now he got no positive response. [4]
In view of the same, without expressing any opinion on merits of the case, this present writ petition is disposed of directing the respondent Nos. 4 and 5 to consider the matter, more particularly in light
of the order dated 28.01.2026 passed by the Under Secretary to the Govt. of Tripura and take a decision within a period of 02 months from the date of receipt of the copy of this order in accordance with law. The said decision be communicated to the petitioner as early as possible.

With the above observation and direction, this present writ petition stands disposed of. As a sequel, miscellaneous application(s), pending if any, shall stand closed. DR. T.AMARNATH GOUD,J
