THIS PETITION COMING ON FOR PRELIMINARY HEARING IN 'B' GROUP, THROUGH PHYSICAL HEARING/VIDEO CONFERENCING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: - 5 - HC-KAR NC: 2026:KHC:33030 WP No. 5282 of 2025 CORAM: HON'BLE MR. JUSTICE M.I.ARUN ORAL ORDER 1. The petitioner was working as the Secretary of the second respondent - Society. It is his case that his resignation was obtained by way of coercion. However, he sought to withdraw his resignation immediately on the very next day. But, in disregard of the regulations, the second respondent accepted the same. Aggrieved by the same, the petitioner has raised a dispute before the first respondent and he has prayed for grant of an interim order not to appoint anybody as Secretary of the second respondent - Society. However, the interim prayer has been rejected. Aggrieved by the same, the present writ petition is filed with the following prayers:- "a) Issue a writ of certiorari to quash the order dated 21.10.2024 passed in Dispute No.AR39/DDS/06/2024-25 by 1st Respondent Vide ANNEXURE-H consequently allow the interim application filed by the Petitioner vide ANNEXURE-D dated:30.09.2024 to the writ petition. - 6 - HC-KAR NC: 2026:KHC:33030 WP No. 5282 of 2025 b) Pass any appropriate writ, order or direction as this Hon'ble Court deem it fit and proper in the facts and circumstances of the case and allow this Writ petition with cost, in the ends of justice and equity. INTERIM PRAYER "Pending disposal of the above writ petition, it is respectfully prayed that this Hon'ble Court be pleased to stay Order dated 21.10.2024 passed in Dispute No. AR39/DDS/06/2024-25 by 1st Respondent Vide ANNEXURE-H, in the interest of justice and equity." 2. This Court on 03.04.2025, passed the following interim order:- "1. Learned AGA is directed to accept notice for respondent No.1. 2. Issue emergent notice to respondent No.2 to 13 returnable by 24.4.2025. 3. Learned counsel for the petitioner is also permitted to take out hand summons to respondents No.2 to 13 and file the served - 7 - HC-KAR NC: 2026:KHC:33030 WP No. 5282 of 2025 hand summons with the registry on or before 16.4.2025. 4. Respondent No.2 is restrained from appointing any new person as secretary of respondent No.2 till that date. 5. Re-list on 24.4.2025." 3. It is submitted that the second respondent - Society is presently functioning with the help of a temporary Secretary in the light of the interim order passed by this Court. 4. Both the learned counsel for the petitioner as well as learned AGA together submit that the writ petition may be disposed of with a direction to the first respondent to dispose of the dispute pending before it as expeditiously as possible and that the benefit of interim order granted by this Court may be extended till such disposal. Hence, without going into the merits of the case the following order is passed:- ORDER i. The first respondent is directed to dispose of dispute No.JDgï39/rrJ¸ï/06/2024-2025 pending on its - 8 - HC-KAR NC: 2026:KHC:33030 WP No. 5282 of 2025 file within a period of four months from the date of receipt of a certified copy of this order. ii. The interim order dated 03.04.2025 passed by this Court shall continue till the disposal of the said dispute by the first respondent. iii. Till a decision is taken by the first respondent, the second respondent can continue to function with the help of a temporary Secretary. iv. It is hereby made clear that no opinion is expressed on the merits of the case and the first respondent shall dispose of the dispute in accordance with law, on the basis of the pleadings and the evidence let-in by the parties. v.
