Learned advocate appearing for the petitioner submits that the petitioner is in custody for 6 years 10 months and till date out of 30 witnesses proposed by the prosecution to prove its case, 12 witnesses have been examined. Learned advocate for the State opposes the prayer for bail. However, having regard to the fact that 18 more witnesses are yet to be examined, without entering into the merits of the case, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner, namely, Momina Bibi shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees 2 Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned ACJM, Kalna. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Purba Bardhaman without prior permission of the learned trial court. Thus, CRM(M)1480 of 2026 is allowed. Memo of Evidence submitted by the State be kept with the record.
