JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioner is before the Court seeking for the following prayers: "a) Issue an appropriate writ, order or direction quashing entire proceeding Crime - 3 - HC-KAR CNR: KAHC010713992025 NC: 2026:KHC:40248 WP No. 33207 of 2025 No.430/2025 pending on the file of the Ld. XI Addl. Chief Judicial Magistrate, Bangalore (vide Annexure-C; b) Consequently, issue an appropriate writ, order or direction quashing the complaint and FIR in Crime No.430/2025 dated 05.07.2025 filed by the Respondent Police for the offence punishable under sections 120B, 420, 471, 468, 465 of the Indian Penal Code arraigning the petitioner as Accused No.2 (vide Annexure- A and B); c) Pass/issue such other needy directions/orders in favour of the petitioners under the circumstances of the case in the interest of justice." 2. Learned counsel for the petitioner and respondent No.2 in unison submit that during the pendency of the case, the parties to the lis have settled the dispute and file an interlocutory application in I.A.No.1/2026 under Section 482 r/w. 320(2) of the Cr.P.C., along with affidavit of the respondent No.2, seeking permission to compound the offences. 3. The settlement recognizes the closure of the present proceedings which are for the offences punishable under Sections 120B, 420, 471, 468 & 465 of I.P.C. The settlement reads as follows – APPLICATION UNDER SECTION 320(2) Cr.P.C. - 4 - HC-KAR CNR: KAHC010713992025 NC: 2026:KHC:40248 WP No. 33207 of 2025 The petitioner & Respondent No.2 beg to submit as follows, "1. The Petitioner & Respondent No.2 in the above case most respectfully submits that, the respondent No.2 field the complaint before the Ramamurthy Nagar Police, against Petitioner for alleged offences punishable under Sections 120B, 420, 471, 468 & 465 of I.P.C. 2. After the receipt of the complaint the S.H.O., Ramamurthy Nagar Police had registered a case in Cr.No.430/2025 on 05-07-2025 against the Petitioner for alleged offences punishable under Sections 120B, 420, 471, 468 & 468 of I.P.C. 3. It is further submitted that, at the intervention of elders and well-wishers the complainant/respondent No.2 & Petitioner has decided to compromise in the above case in the greater interest of the complainant & petitioner them self, hence it is prayed that this Hon'ble Court may kindly be pleased to quash the FIR & Complaint. WHEREFORE, the Petitioner & complainant most respectfully prays that this Hon'ble court be pleased to quash the FIR & Complaint, in the interest of justice and equity. 4. In the light of the settlement arrived at between the parties, Therefore, I deem it appropriate to accept the - 5 - HC-KAR CNR: KAHC010713992025 NC: 2026:KHC:40248 WP No. 33207 of 2025 application and the affidavit so filed and close the proceedings against the petitioner in the subject petition. 5. The crime so registered against the petitioner pursuant to the crime in Crime No.430/2025, registered by the Ramamurthy Nagar Police, pending on the file of the Learned XI Additional Chief Judicial Magistrate, Bengaluru, stands quashed. 6. For the aforesaid reasons, the following: ORDER (i) Criminal Petition is disposed. (ii) Investigation in Crime No.430/2025, registered by the Ramamurthy Nagar Police Station, pending before the learned XI Additional Chief Judicial Magistrate, Bengaluru stands quashed insofar as the petitioner- accused No.2 is concerned.
