Petitioner seeks quashing of order dated 06.03.2026 of learned Chief Judicial Magistrate, Bathinda, vide which his bail in Complaint No. COMA-763-2024 titled ‘State Vs. Eshaan’ under Section 160(2) Railway Act was cancelled and bonds forfeited to the State. 2. Learned counsel for the petitioner submits that petitioner was facing trial in Complaint No. COMA-763-2024 which was fixed for precharge evidence for 23.11.2025. However, the case was taken up on 21.11.2025 by learned Chief Judicial Magistrate, Bathinda observing that the date was wrongly mentioned as 23.11.2025 instead of 21.11.2025. Petitioner could not put in appearance on 21.11.2025 having no intimation of the date of hearing. Thereafter, the case was adjourned to 06.03.2026 and on 06.03.2026, petitioner’s bail was cancelled and non- bailable warrants were issued. Learned counsel further submits that absence of the petitioner on 21.11.2025 and on the subsequent date i.e. SUMIT SINGLA06.03.2026 was not intentional and petitioner had every intention to put 2026.07.21 19:00 I attest to the accuracy and integrity of this document CRM-M-39738-2026 (O&M) in appearance and face the trial. 3. Notice of motion. 4. Mr. Rajiv Sharma, Senior Central Government Counsel appears on behalf of RPF and opposes the prayer of the petitioner. 5. Record perused. Petitioner was on bail in the aforementioned case when the case was adjourned to 23.11.2025 for precharge evidence. However, the case was taken up on 21.11.2025 and adjourned to 06.03.2026. Petitioner had no notice of the date fixed i.e. 06.03.2026 and his absence on the said date does not appear to be intentional. Since, it appears to the Court that petitioner intends to join the proceedings and face trial, he must be permitted to do so. Petitioner is accordingly directed to put in appearance before learned Chief Judicial Magistrate, Bathinda within a period of 10 days from today and move appropriate application for regular bail which learned trial Court shall decide the same day. Till then, non-bailable warrants of arrest of the petitioner shall be kept in abeyance. 6. The petition stands disposed of, on the above terms. 7. Pending miscellaneous applications, if any, stand disposed of.
