Kausik (Rejected) CRM (NDPS) 1711 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Nabagram Police Station Case No. 319 of 2025 dated 29th May, 2025 under Section 20(b)/29 of the NDPS Act, 1985. And In the matter of : Biswamitra Adhikari ……Petitioner. Mr. Arnab Chatterjee Mr. Avik Ghosh Ms. Ankusha Ghosh ……for the Petitioner. Mr. Subhajit Chatterjee ……for the State. Learned advocate appearing for the petitioner submits that petitioner was arrested on 29.05.2025 and even after the charge sheet having been submitted on 19.11.2025, there is hardly been progress in the trial. As no witness has been examined even after the charges were framed on 08.01.2026, it has been complained that six dates were fixed and on none of the dates witnesses were present. Learned advocate for the State opposes the prayer for bail and submits that in the present case 80 Kgs. 890 Gms. of Ganja were recovered. Petitioner is the sole accused and prosecution be granted opportunity to proceed with the trial. 2 Having considered the huge quantum of Ganja recovered in the present case, prosecution would put in efforts to produce the witnesses on the dates fixed by the learned Trial Court. Petitioner would renew his prayer for bail after the evidence of the seizure list witnesses are over. At this stage, prayer for bail of the petitioner in CRM (NDPS) 1711 of 2026 is rejected. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
