The instant bail applications have been preferred by the respective petitioners for grant of regular bail for the offences registered under Sections 140(2), 3(5) of BNS in connection with Karmatanr PS Case No. 106 of 2025 pending in the Court of learned C.J.M., Jamtara. 3. Learned counsel for the petitioners submits that the matter relates to extortion and kidnapping however the petitioners are innocent 2026:JHHC:9210 2 and have not committed any offence. It is submitted that FIR was not lodged against the above-named petitioners and name of these petitioners transpired on the basis of confessional statement of co-accused, namely, Abdul Hasib. It is further submitted that the petitioners, namely, Shivlal Marandi and Mistar Ansari @ Mister Ansari have not been identified in the Test Identification Parade and co-accused, namely, Wajid Ansari in B.A No. 2268 of 2026 has been granted bail vide order dated 23.03.2026 by the Co-ordinate Bench of this Court. Learned counsel for the petitioners further submits that the petitioners are languishing in judicial custody since 05.11.2025 as such they may be enlarged on bail. 4. Learned APPs oppose the prayer for bail of the petitioners. 5. Having regard to the fact that there is direct allegation against the petitioner, namely, Samad Ansari in B.A No. 782 of 2026, I am not inclined to enlarge the petitioner, namely, Samad Ansari in B.A No. 782 of 2026 on bail and accordingly, his prayer for bail is rejected. 6. So far as petitioners, namely, Shivlal Marandi in B.A No. 783 of 2026 and Mistar Ansari @ Mister Ansari in B.A No. 787 of 2026 are concerned, since they have not been identified in Test Identification Parade and are lying in custody since 05.11.2025, I am inclined to enlarge the petitioners, namely, Shivlal Marandi in B.A No. 783 of 2026 and Mistar Ansari @ Mister Ansari in B.A No. 787 of 2026 on bail. Accordingly, the petitioners, above-named, in B.A No. 783 of 2026 and B.A No. 787 of 2026 are directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) each with two sureties of the like amount each to the satisfaction of learned learned C.J.M., Jamtara in connection with Karmatanr PS Case No. 106 of 2025. 7. It is made clear that the petitioners in B.A No. 783 of 2026 and B.A No. 787 of 2026 shall appear on each and every date before the 2026:JHHC:9210 3 learned trial Court and they shall not threaten any witness and shall co-operate in trial and if any adverse report will come against these petitioners, learned trial Court shall be at liberty to cancel the bail of these petitioners.
