JUSTICE B M SHYAM PRASAD - 3 - HC-KAR NC: 2026:KHC:32984 WP No. 19507 of 2026 ORAL ORDER The petitioner is aggrieved by the Government Order dated 10.04.2000 [Annexure-F], and this order directs cancellation of revenue entries for the petitioner’s property. This impugned order is common to the petitioner's property and the properties of certain other persons. The petitioner asserts that she has purchased the subject property from the legal heirs of Sri. Seenappa, son of Rangaiah, that she has the benefit of the revenue entries but the decision to cancel the revenue entries is on the ground that a certain Sri. Seenappa, son of Rangaiah has availed the benefit of an allotment under the Ashraya Scheme notwithstanding the fact that he owned another immovable property, and that the petitioner is not issued with any notice of the proceedings to cancel the revenue entries. 2. Sri Sunil K N, the learned counsel for the petitioner, Sri Kenche Gowda, a learned Additional - 4 - HC-KAR NC: 2026:KHC:32984 WP No. 19507 of 2026 Government Advocate who accepts notice for the first to third respondents and Sri Y D Shivashankar, a learned counsel who accepts notice for the fourth respondent, are heard for disposal of this petition in the light of this Court's order dated 20.03.2024 in the writ petition in W.P. No.15943/2022 and connected matters. This Court, in W.P. No.15943/2022 and connected matters, has essentially interfered with the impugned order on the ground that it is without notice or opportunity but observing that the interference cannot foreclose the new proceedings. The petitioner asserts that the impugned order is without notice. Hence, the following. ORDER [a] The petition is allowed. [b] The impugned order dated 10.04.2000 [Annexure-F] is quashed, and the fourth respondent [the Local Authority] is directed to restore the - 5 - HC-KAR NC: 2026:KHC:32984 WP No. 19507 of 2026 Khata in favour of the petitioner for her property and issue e-Khata. [c] It is observed that this restoration and issuance of e-Khata would be subject to the outcome of the proceedings that the respondent/s could initiate within a reasonable period of time.
