By way of this petition, the petitioner has sought the following relief(s):- “10.1 To call for the entire records available in the office of the Respondents pertaining to the case of petitioners. 10.2 That the Hon'ble High Court may kindly be pleased to direct the respondent authority to consider the case of the petitioner for promotion from the post of Upper Division Teacher to Lecturer (Hindi/History). Mr. Parag Kotecha would contend that the petitioner was eligible and entitled for promotion to the post of Lecturer(Hindi/History) subject along with his co-employees, who were promoted to the post of Lecturers vide order dated 29.12.2018. Mr. Kotecha would vehemently submit that the State in its return has admitted their mistake. He would submit that the matter of the petitioner was referred to the Director, Directorate of the Public Instruction, Chhattisgarh for consideration vide proposal dated 13.09.2018. He would contend that till date no decision has been taken so far. He would pray to allow this petition. 3. On the other hand, Mr. Khulesh Sahu, Panel Lawyer appearing for the State would oppose. 4. I have heard learned counsel for the parties and perused the documents placed on record. 5. Paragraphs 6 and 7 of return filed by the State are reproduced herein-below :- “6. It is respectfully submitted that as despite possessing the requisite qualification and qualifying 3 services required for promotion, inadvertently the petitioner could not be promoted due to the fact that his name was left and therefore, vide proposal dated 29/11/2017, the name of the petitioner was forwarded to the Director, Directorate of Public Instructions, Chhattisgarh for consideration of his name for promotion on the post of Lecturer. Copy of the proposal dated 29/11/2017 is filed herewith as Annexure R/1. 7. It is respectfully submitted that in furtherance of the aforesaid proposal dated 29/11/2017 (Annexure R/1), again another dated 13/09/2018 proposal recommending the names of certain teachers including the petitioner was sent to the Director Directorate of Public Instructions, Chhattisgarh for consideration of their cases for promotion on the post of Lecturer and to demonstrate this fact, copy of the proposal dated 13/09/2018 is filed herewith as Annexure R/2.” 6. Having considered the fact that due to mistake of the department, name of the petitioner was not considered for promotion and his name has already been forwarded to the Director, Directorate of Public Instruction, Chhattisgarh for consideration for promotion to the post of Lecturer (Hindi/History) vide order dated 29.11.2017 and subsequent proposal dated 13.09.2018. This petition, at this juncture, is disposed of with a direction to 4 the Director, Directorate of Public Instruction, Chhattisgarh to take decision, preferably within a period of 60 days from the date of receipt of copy of this order. 7.
