By way of this application, the applicants are seeking bail in connection with Crime No.116 of 2026 registered with Sindhkhed Raja Police Station, District Buldhana, for the offences punishable under Sections 118(1), 310(2), 299, 126(2) and 311 of the Bharatiya Nyaya Sanhita, 2023. 3. The F.I.R. came to be lodged by the informant alleging that on 06/06/2026 when the informant along with Bal Krishnaji Vaishnav Maharaj and another person were proceeding towards Sambhajinagar from Sindkhed Raja, they noticed a Piyush Mahajan 2026:BHC-NAG:10512 2 43-Cr.BA-1006-2026 vehicle allegedly transporting cattle. When they attempted to stop the said vehicle, the driver refused to stop, and therefore, the informant followed the said vehicle. That time 8 to 10 individuals approached them and started abusing them. Fearing for their safety, the informant reversed their vehicle towards the Sindkhed Raja bus stand. Further 10 to 15 unidentified/unknown persons arrived at the Sindkhed Raja Bus Stand on motorcycles, who abused and assaulted the informant and Bal Krishna Maharaj with sticks and fists and also snatched an amount of Rs.3720/- from the pocket of the informant and therefore the report against unknown persons was registered. During investigation, the applicant was arraigned as an accused. 4. The learned counsel for the applicants submits that the applicants are not named in the F.I.R. No role is attributed to the applicants, and therefore, considering this aspect, the applicants prayed to be enlarged on bail. 5. On the other hand, the learned A.P.P. vehemently opposed the application on the ground that the applicants have actively participated in the alleged crime. Local residents of Sindkhedraja village have taken the name of the present applicants alleging that they were in the group of 10 to 15 Piyush Mahajan 3 43-Cr.BA-1006-2026 persons, who assaulted and abused the informant and Bal Krishna Maharaj and snatched the money. Another FIR bearing Crime No.115/2026 came to be registered against one Shaikh Bilal Shaikh alleging that he was illegally carrying cattle in his vehicle- tempo. So far as the applicants are concerned, the applicants are the part of group of 10 to 15 unidentified persons. The allegations of assault and snatching of money are necessarily to be considered, and therefore, the application is prayed to be rejected. 6. I have considered the rival submissions and perused the record. From the perusal of the F.I.R. it is revealed that there is no name of the applicants nor there is any role attributed to the applicants in the First Information Report. No identification parade has also been carried out till today. The applicant Nos.1 to 4 are in jail since 07/06/2026 and applicant Nos.5 to 6 are in jail since 10/06/2026 and the charge-sheet is yet to be filed, as no further incarceration is required, I am inclined to enlarge the applicants on bail. Hence the following order : O R D E R (i) The Criminal Application is allowed; Piyush Mahajan 4 43-Cr.BA-1006-2026 (ii) The applicants ((1) Syed Jalil Syed Salim, (2) Sheikh Jamir Sheikh Khamar, (3) Sheikh Bilal Sheikh Khairu, (4) Syed Nasir Syed Isak, (5) Sheikh Sohel Sheikh Gopi, (6) Sheikh Hannan Sheikh Khairu, they be released on bail in connection with Crime No.116 of 2026 registered with Sindhkhed Raja Police Station, District Buldhana, for the offences punishable under Sections 118(1), 310(2), 299, 126(2) and 311 of the Bharatiya Nyaya Sanhita, 2023, on furnishing P.R. bond of Rs.50,000/- with one surety in the like amount each; (iii) The accused shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the evidence; (iv) The accused shall provide their residential address and cell number to the Police Station concerned and shall not change their place of residence without prior intimation to the Investigating Agency; (v) The accused shall attend the concerned Police Station twice a month, i.e., on 1st and 15th day of each month during 10.00 am to 2.00 pm till the filing of the charge-sheet and after commencement of trial, they shall attend Piyush Mahajan 5 43-Cr.BA-1006-2026 the trial. If they fail to attend or fail to comply with the aforesaid conditions, their default would entail the State to ask for cancellation of bail. (vi) Pending Misc.
