ORAL ORDER
1. Accused in Crime No.66 of 2026 registered by Andersonpet Police Station, KGF for offences punishable under Sections 113 and 114 of Karnataka Police Act, 1963 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail.

Learned counsel for the petitioner and learned Additional State Public Prosecutor on behalf of the respondent - State.

FIR Crime No.66 of 2026 was registered by Andersonpet Police Station, KGF for the aforesaid offences against the petitioner herein, based on the first information dated 19.06.2026 received from Sri Manjunatha, police officer attached to Andersonpet Police Station. In the said case, petitioner was arrested on 19.06.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.625 of 2026, was rejected on
20.07.2026. Therefore, he is before this Court.

Learned counsel for the petitioner submits that, the externment order passed against the petitioner has been stayed by this Court. He submits that, petitioner is in custody in the present case for the last more than one month. Accordingly, he prays to allow the petition.
5. Per contra, learned Additional State Public Prosecutor who has opposed the petition submits that, petitioner is a person with criminal antecedents. Accordingly, he prays to dismiss the petition.

First information in the present case is filed with an allegation that petitioner as against whom an externment order was passed on 05.06.2026 by the competent authority, in violation of the said externment order, had entered the limits of KGF and it is under these circumstances, FIR was registered against him in Crime No.66 of 2026. Maximum punishment for the alleged offences is imprisonment for a period upto two years.

Learned counsel for the petitioner has produced copy of the order passed in W.P.No.19300 of 2026 by the Co-

ordinate bench of this Court in which the externment order passed against the petitioner has been stayed by order dated 07.07.2026 for a period of one month. Under the circumstances, I am of the opinion that, petitioner's prayer for grant of regular bail needs to be answered affirmatively. Accordingly, the following:-
ORDER Criminal petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.66 of 2026 registered by Andersonpet Police Station, KGF for offences punishable under Sections 113 and 114 of Karnataka Police Act, 1963, subject to the following conditions:- a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless

the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future.
