JUSTICE RAJESH SHANKAR ----- For the Appellant: Mr. Manoj Tandon, Advocate For the Res. Nos. 1 to 6: Mr. Gaurav Raj, A.C. to A.A.G.-II For the Res. No. 7: Mr. Ajit Kumar, Sr. Advocate ----- 03/02.04.2026 1. Heard learned counsel for the parties. 2. This appeal is directed against the learned Single Judge’s order dated 13.08.2025 granting ad-interim relief that “till further orders, no coercive steps shall be taken against the petitioner on the strength of impugned order.” 3. Learned counsel for the appellant points out that though this case was listed on 04.09.2025, however, it could not be taken up on the said date. He further points out that after the said date, no date has been fixed in the matter and ad-interim order is continuing indefinitely. 4. Learned counsel for the respondents has raised several issues inter-alia regarding maintainability of this appeal. 2026:JHHC:9293-DB 2 5. However, for the present, we do not intend to go into all these issues because we are basically concerned with ad-interim relief. 6. However, we agree with the learned counsel for the appellant that an ad-interim order should not continue indefinitely without hearing the parties on the issue of either confirmation or vacation of such order. 7. Accordingly, we request the learned Single Judge having the assignment/roster to take up W.P. (C) No. 4253 of 2025 at the earliest and upon hearing the learned counsel for the parties, to decide whether ad-interim order dated 13.08.2025 deserves to be confirmed or vacated. 8. Learned counsel for the parties submit that the pleadings are complete and they will not seek any unnecessary adjournment from the Court. 9. With the above request, we dispose of this appeal by clarifying that we have not examined the merits of the rival contentions. 10. The present appeal is accordingly disposed of in the above terms without any order for costs. (M. S. SONAK, C.J.) (RAJESH SHANKAR, J.) 02.04.2026 Satish/Vikas/ Uploaded on 04.04.2026
