1. Heard.
2. The petitioner has challenged the order dated 27.02.2018, whereby the services of the petitioner to the post of Kotwar were terminated by the Tehsildar, Tehsil Arang, District Raipur (C.G.). The petitioner has further challenged the show-cause notice dated
16.01.2018.
3. Mr. Solapurkar, learned counsel appearing for the petitioner would
-2- submit that the procedure contemplated under Section 230 of the Chhattisgarh Land Revenue Code and the Rules made thereunder were not followed by the authority concerned; therefore, the impugned order is bad in law.
4. On the other hand, Mr. Pandey, learned Government Advocate appearing for the State/respondents, would oppose the
submissions. He would submit that the order passed by the Tehsildar is appealable under Section 44 of the Chhattisgarh Land Revenue Code before the Sub-Divisional Officer.
5. Heard learned counsel appearing for the parties and perused the documents placed on record.
6. Having considered the fact that the order passed by the Tehsildar, whereby the petitioner was removed from the post of Kotwar, is appealable before the Sub-Divisional Officer, this petition is
disposed of with liberty to the petitioner to approach the Appellate Authority. If the petitioner prefers an appeal before the Sub- Divisional Officer, the authority concerned shall decide the same expeditiously, strictly in accordance with law, after affording due opportunity of hearing to all the interested parties.
7. With the aforesaid observation(s)/direction(s), the present petition is disposed of.
8. Certified copy be returned after retaining its xerox copy.
