Versus Debashish Sreemany Ms. Akanksha Mukherjee …for the petitioners This application under Article 227 of the Constitution of India is at the instance of the plaintiffs in Title Suit no. 392 of 2020 praying for direction upon the learned Civil Judge (Senior Division), 4th Court at Alipore to dispose of the Title Suit no. 392 of 2020 along with Title Suit No. 694 of 2020, expeditiously. The learned advocate appearing for the petitioners submits that pursuant to an order passed by this Hon’ble Court, Title Suit no. 392 of 2020 was directed to hear analogously with Title Suit 694 of 2020. She further submits that in Title Suit no. 694 of 2020 the opposite party herein filed an application for amendment of the plaint on 22nd June, 2026. She further submits that 22nd September, 2026 is fixed for hearing of the amendment application filed in Title Suit no. 694 of 2020. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned Advocate for the petitioners, this civil revisional application 2 stands disposed of by requesting the learned Civil Judge (Senior Division), 4th Court, at Alipore to take up the hearing of the application for amendment of plaint filed in Title Suit No. 694 of 2020 on the next date fixed and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. After disposal of the said amendment application as well as any other interlocutory application that may be pending in respect of the aforesaid suits, the learned trial judge shall make an endeavour to dispose of the Title Suit Nos. 292 of 2020 and 694 of 2020 as expeditiously as possible, without granting any unnecessary adjournments to either of the parties.
