[2026:RJ-JP:18505] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 3388/2026 Roshan Singh S/o Baran Singh, aged 23 Years, R/o Khadagpura, Police Station Pidawa, District Jhalawar (Rajasthan) (Accused at present confined in District Jail, Jhalawar). ----Petitioner Versus State of Rajasthan, through PP ----Respondent For Petitioner(s) : Mr. Anubodh Subodh Jain For Respondent(s) : Mr. Vivek Sharma, PP HON'BLE MR. JUSTICE SANDEEP TANEJA Order 01/05/2026 1. This bail application has been filed on behalf of the accused- petitioner under Section 483 of BNSS in connection with FIR No.232/2025 registered at Police Station Pidawa, District Jhalawar for the offences under Sections 64(1), 332(b), 351(3), 238(b) of BNS and Section 66-E of I.T. Act. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and he has nothing to do with the alleged offences. Learned counsel further submits that though FIR was lodged against the petitioner under Section 3/4 of the POCSO Act, however, no such offence has been found to be proved against the petitioner in the charge-sheet. Learned counsel also submits that the petitioner is in custody since 22.01.2026 and no recovery is required to be made from him. Learned counsel further submits that as per school record, the prosecutrix is major and she has turned hostile before the learned Trial Court, so, there is a bleak chance of conviction of the petitioner. Trial will take [2026:RJ-JP:18505] (2 of 2) [CRLMB-3388/2026] considerable time to conclude, so no fruitful purpose would be served by keeping the petitioner in custody and therefore, prays that the petitioner may be granted the benefit of bail. 3. Per contra, learned Public Prosecutor has opposed the bail application. However, he is not in a position to dispute the fact that the prosecutrix has turned hostile. 4. Learned Public Prosecutor further submits that the complainant has duly been informed about hearing of this bail application. However, despite information, no one has put in appearance on her behalf to oppose the bail application. 5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, as also the facts that the prosecutrix has turned hostile and trial will take considerably long time in its conclusion, but without commenting anything on merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail. 6. Therefore, this bail application under Section 483 BNSS is allowed and the accused-petitioner Roshan Singh S/o Baran Singh is ordered to be released on bail, provided he furnishes a personal bond in the sum of Rs. 50,000/- with two sureties of Rs. 25,000/- each to the satisfaction of the learned Trial Court, with the stipulation that he shall appear before that Court or any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
