For the South 24 Parganas Zilla Parishad The petitioner was granted lease by the Zilla Parishad in respect of 10 decimals of land in L. R. Dag no. 244 Khatian no. 1003 in Mouza Kalabaru by virtue of a registered deed of lease dated 4th August, 2023 for a period of three years commencing from 1st April, 2023. Unauthorised construction was found on the said land for which the petitioner was unable to commence pisciculture in terms of the lease. The petitioner approached this Court in WPA 325 of 2024 for demolition of the said unauthorised construction and succeeded in the same. The petitioner seeks consideration of the same. In view of the contention of the petitioner made out in the writ petition, the District Magistrate, South 24 Parganas being the 2nd respondent herein, is directed to consider and dispose of the representation within four weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law. The decision taken by the authority shall be communicated to the petitioner within a week thereof. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
