CRR 3501 of 2026
Srijita Mitra
Vs.
The State of West Bengal & Anr.
Mr. Mit Guha Roy Mr. Sayan Sarkar Mr. Sneha Saha …for the Petitioner
In this application, the petitioner herein has prayed for a direction upon the court below for expeditious disposal of the prayer for interim monetary relief and also for expeditious disposal of the main proceeding being AC case no. 310 of 2026, presently pending before the learned Judicial Magistrate, 8th Court, Alipore. Being aggrieved by the inordinate delay caused in disposal of the said proceeding, learned counsel for the petitioner submits that on 3rd February, 2026, the petitioner filed an application under Section 12 of the Protection of Women from Domestic Violence Act, 2005 along with a prayer for interim monetary relief and other interim protections. Since then, the said application is pending for disposal and has not been disposed of as of yet. Therefore, she prayed for necessary direction upon the court below for disposal of the said proceeding. Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite parties will have no cause to prejudice
2 and as such, the service of copy of application upon the opposite parties is hereby dispensed with. Having considered the submissions made on behalf of the petitioner and that the application for interim monetary relief is pending for disposal for a considerable period of time, I find that the prayer made by the petitioner is justified and required to be allowed in order to secure the ends of justice. In view of above, the instant application being CRR 3501 of 2026 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the prayer for interim monetary relief and to dispose of the same preferably within a period of three months from the next date of hearing and thereafter, to make his best effort to conclude the entire proceeding for its final disposal at the earliest. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities. (Dr. Ajoy Kumar Mukherjee, J.)
