105 IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH CRM-M No.37528 of 2026 Date of Decision:-21.07.2026 Gurjant Singh …..Petitioner. Versus State of Punjab .....Respondent. CORAM: HON’BLE MR. JUSTICE VIKRAM AGGARWAL ***** Present:- Mr. Rahul Aggarwal, Advocate for the petitioner. Mr. Kamalpreet Bawa, DAG, Punjab. VIKRAM AGGARWAL, J. (ORAL) Prayer in the present petition preferred by the petitioner under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, ‘the BNSS’) is for the grant of anticipatory bail in case FIR No.83 dated 20.04.2026 registered under Sections 21 (C), 25 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’), at Police Station Anti-Narcotics Force (ANTF), ANTF Wing, SAS Nagar. 2. As per the case of the prosecution, on 20.04.2026, on receipt of a secret information, 03 persons namely Jarman Singh, Simran Singh and Jora Singh were apprehended. The information was that they were indulging in smuggling of heroin from Pakistan. Upon their arrest, heroin weighing 1 Kg. 80 grams was recovered from Jarman Singh. During YAG DUTT 2026.07.22 18:12 I attest to the accuracy and authenticity of this order/judgment. CRM-M No.37528 of 2026 -2- interrogation, Jarman Singh is alleged to have confessed to his links with smugglers from Pakistan and is also alleged to have suffered a disclosure statement naming the petitioner (Gurjant Singh) and two others namely Navdeep Singh and Gurpreet Singh, who used to collect the consignments of heroin in accordance with directions received from the smugglers from Pakistan. Under the circumstances, the petitioner was arraigned as an accused. 3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated. He submits that the petitioner was not apprehended at the spot and, therefore, no recovery was made from him. He submits that the name of the petitioner has erroneously been introduced by the police by extracting a disclosure statement from Jarman Singh while he was in custody. He submits that the antecedents of the petitioner are clean and that he is willing to join investigation and abide by any condition imposed by the Court. 4. Per contra, learned State counsel has opposed the bail application stating that as per the statement of Jarman Singh, it was the petitioner who used to take delivery of consignment of heroin sent from Pakistan in his own vehicle. Learned State counsel submits that under the circumstances, custodial interrogation of the petitioner would be required. 5. I have considered the submissions made by learned counsel for the parties. 6. Concededly, a huge consignment of heroin weighing 1 Kg. 80 grams which is four times the commercial quantity of the same was YAG DUTT 2026.07.22 18:12 I attest to the accuracy and authenticity of this order/judgment. CRM-M No.37528 of 2026 -3- recovered from Jarman Singh on his arrest. Jarman Singh named the present petitioner along with two others to be the persons who used to collect consignments of heroin from Pakistan. No doubt, the antecedents of the petitioner are clean and no other case stands registered against him. However, in the considered opinion of this Court, this alone would not be a sufficient ground to extend the concession of anticipatory bail to the petitioner. It is well known that the menace of drugs has spread its tentacles far and wide and in such cases, custody interrogation is normally imperative to elicit the truth. 7. Keeping in view the nature of the allegations, this Court does not find it to be a case where the concession of anticipatory bail should be extended to the petitioner. 8. That being so, the petition is found to be devoid of merit and is accordingly dismissed.
