Case No.311 of 2026 dated 23.06.2026 under Sections 85/107/65(1)/3(5) of the BNS, 2023 and Section 6 of the POCSO Act and 9/10/11 of the Child Marriage Act, 2006. And In the matter of: XXX and another … petitioners Mr. Asraf Mandal … for the petitioners Mr. Ajay Ray Mr. Bibaswan Mukherjee … for the State 1. Affidavit of service filed by the petitioners is taken on record. 2. Despite service no one appears on behalf of the de facto complainant. 3. Learned advocate for the petitioners submits that the petitioners are the sister-in-law and the father-in-law of the alleged victim. The victim committed suicide. She was 14 years of age. On going through the materials available in the case diary, it transpires that the State recorded the statement under Section 183 of the BNSS as well as the statements of neighbours recorded under Section 180 of the BNSS which placed the present petitioners at the date and time of the incident. Specific overact has been attributed by the petitioners. The alleged victim was a minor girl aged 2 about 14 years. She committed suicide by unknown poisoning. There appears serious allegation against the petitioners of inflicting torture upon the victim girl. The investigation of the case is still going on. Charge-sheet has not yet been submitted. 4. In such circumstances and on the basis of the aforesaid materials available in the case diary, I am not inclined to grant anticipatory bail to the petitioners. 5. The Prayer for anticipatory bail of the petitioners is rejected. 6. CRM (A) 2395 of 2026 is disposed of. 7. Urgent certified photostat copy of this order, if applied for, be supplied to the parties upon compliance with requisite formalities. (Md. Shabbar Rashidi, J.)
