Kausik (Rejected) CRM (NDPS) 1700 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bizpur Police Station Case No. 246 of 2025 dated 05.12.2025 under section 20(b)(ii)(c) of the NDPS Act. And In the matter of : Amrit Manna ……Petitioner. Mr. Debasis Kar Mr. Arka Tilak Bhadra Ms. Paramita Mukherjee ……for the Petitioner. Mr. Subhasish Pachhal Mr. Shivam Mishra ……for the State. Learned advocate appearing for the petitioner submits petitioner is innocent and has been falsely implicated in connection with the instant case. The arrest was in contravention of the provisions of law. Additionally, the name of some of the witnesses have been omitted in the charge sheet, although such independent witnesses were present in course of the seizure. Learned advocate for the State opposes the prayer for bail and submits that the total seizure in the present case is 48.300 Kgs. of Ganja from the joint possession of the petitioner and others. 2 Having considered the issues canvassed by the petitioner, the question of fact are to be addressed at the stage of trial, as such, I am not inclined to grant bail as the rigors of Section 37 of the NDPS Act is attracted in the present case. Thus, CRM (NDPS) 1700 of 2026 is dismissed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
