CRM-M-39255-2026 1 110 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH CRM-M-39255-2026 Date of Decision: 20.07.2026 PRABHJOT SINGH ALIAS PRABH .....PETITIONER VERSUS STATE OF PUNJAB ....RESPONDENT CORAM: HON’BLE MR. JUSTICE H.S.GREWAL Present: Mr.P.S.Miglani, Advocate for the petitioner. **** H.S. GREWAL, J. (ORAL) 1. This petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 438 Cr.P.C.) for grant of anticipatory bail to the petitioner in case FIR No.08, dated 17.02.2026 (Annexure P-1), under Section 25, 54, 59 Arms Act and Sections 111, 3(5) of BNS 2023 (Section 34 IPC) registered at Police Station GRP, Pathankot, District Pathankot. 2. Briefly stated, the prosecution case is that on 17.02.2026, LR/ASI Palwinder Singh, Incharge, Police Post Railway Police, Pathankot Cantt., along with other police officials, was conducting checking in the RENU RAWAT 2026.07.22 12.11 I attest to the accuracy and integrity of this document Chandigarh CRM-M-39255-2026 2 railway yard, Army loading area and the temporary route leading from the National Highway to Platform Nos. 2/3 of Railway Station, Pathankot Cantt. During the checking, two young men were noticed approaching from Platform Nos. 2/3 towards the National Highway. On noticing the police party, both of them allegedly turned back and attempted to flee. The police party chased them, whereupon one of the persons allegedly took out a pistol from his waist and brandished it in an attempt to intimidate the police officials, but succeeded in escaping. The other person, namely Manvir Singh Gill @ Manni, was apprehended on the spot. Upon his search, one semi-automatic Beretta-type pistol with an empty magazine, two magazines (one of a Beretta pistol and another of a Glock pistol) and two mobile phones were recovered from his possession. During interrogation, the co-accused disclosed the identity of the absconding person as the petitioner Prabhjot Singh @ Prabh, and stated that he was carrying a loaded Glock pistol. On the basis of the said disclosure and other material collected during investigation, the petitioner was nominated in the present case. 3. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. It is argued that the allegation that the petitioner managed to escape after brandishing a pistol is inherently improbable, as six police officials were present at the spot and it would not be possible for him to flee from the spot. It is further RENU RAWAT 2026.07.22 12.11 I attest to the accuracy and integrity of this document Chandigarh CRM-M-39255-2026 3 contended that, according to the prosecution itself, the petitioner did not fired any shot despite allegedly carrying a loaded pistol. He further submits that the petitioner is ready and willing to join the investigation. 4. Notice of motion. 5. Mr. P.S.Pandher, Asst. A.G.Punjab accepts notice on behalf of the respondent-State. Learned State counsel opposes the petition and submits that the weapon allegedly carried by the petitioner is yet to be recovered and his custodial interrogation is essential for effecting the recovery of the said weapon. Accordingly, it is prayed that the present petition be dismissed. 6. I have heard learned counsel for the parties and have gone through the record. 7. Keeping in view the facts and circumstances of the case, and considering that the allegations against the petitioner are specific in nature, this Court is of the considered view that the petitioner is not entitled to the concession of extraordinary relief of anticipatory bail. The weapon allegedly carried by the petitioner is yet to be recovered, and his custodial interrogation is necessary for effecting the recovery. Furthermore, the alleged offence involving the use and recovery of an illicit firearm is of a serious in nature. 8. Considering the seriousness of the allegations, the gravity of the offence, the fact that the weapon is yet to be recovered, and the RENU RAWAT 2026.07.22 12.11 I attest to the accuracy and integrity of this document Chandigarh CRM-M-39255-2026 4 necessity of custodial interrogation for a fair and effective investigation, this Court is of the considered view that the petitioner does not deserve the concession of extraordinary relief of anticipatory bail. 9. Accordingly, finding no merit in the present petition, the same is hereby dismissed.
