Learned counsel for the applicant-petitioner submits that the applicant has been falsely implicated in the present case and the main petition, seeking regular bail, is already pending before this Court and listed today itself. It is further argued that the petitioner is a 73-year-old senior citizen suffering from multiple age-related ailments. He is suffering from hypertension and diabetes mellitus for the last about 17 years, besides tuberculosis (T.B.), which is a communicable disease. Learned counsel submits that the petitioner has recently suffered a paralytic stroke, resulting in both his lower limbs becoming non- functional, thereby rendering him virtually bedridden. Owing to his precarious medical condition, he is unable to perform even his routine daily activities and is wholly dependent upon others for his basic needs and care. In view of the serious medical condition of the petitioner, he deserves to be released on interim bail for a period of six weeks to enable him to obtain proper medical treatment. 4. Per contra, learned counsel for the respondent-UOI/NCB has opposed the prayer of the applicant-petitioner by submitting that as per the latest medical status report dated 23.06.2026, the petitioner was produced before the Medical Officer and was found to be calm, conscious, cooperative and well- oriented to time, place and person. It is submitted that although the petitioner is a known case of diabetes mellitus and hypertension and has a past history of pulmonary tuberculosis, he is not undergoing any active treatment for tuberculosis in the Jail Hospital. It is further submitted that the petitioner has complained of diminished vision, knee pain and decreased hearing, for which he has already been examined by specialists at Civil Hospital, Ludhiana, and has been provided appropriate medical advice and symptomatic treatment. present, his general condition is stable and his vitals are in normal limits. It is, thus, argued that no exceptional circumstance has been made out warranting the grant of interim bail. Accordingly, the present application deserves to be dismissed. 5. After hearing learned counsel for the parties and perusing the record, this Court finds no ground to grant the concession of interim bail to the applicant- petitioner. The medical status report dated 23.06.2026 reveals that the petitioner is calm, conscious, cooperative and well-oriented, and is receiving regular medical care in custody.
Though he is a known case of diabetes mellitus and hypertension and has a past history of tuberculosis, there is nothing on record to suggest that his condition is life-threatening or that the requisite medical treatment cannot be provided while he remains in judicial custody. The ailments relating to vision, hearing and knee pain are also being attended to by specialists at Civil Hospital, Ludhiana, and appropriate treatment has been advised. No exceptional circumstance warranting the grant of interim bail is, thus, made out. Accordingly, finding no merit in the present application, the same is hereby dismissed. Now let up take up the main case. 6. CRM-M-16239-2026 (O&M)
After arguing for some time, learned counsel for the petitioner seeks withdrawal of this petition, at this stage. Dismissed as withdrawn. 21.07.2026
