At the time of call accommodation is prayed for on behalf of petitioner since service is not complete. However, on considering the case made out in this writ petition, it is found that no purpose would be sub- served in keeping this writ petition pending. 2. On perusal of the letter of petitioner which is at page 11 of this writ petition, it appears that petitioner requested concerned police authority to register FIR and in support of same prayer is couched in the present writ petition thereby seeking issuance of mandamus directing concerned police authority to take steps and register FIR. 3. There is an alternative remedy available to petitioner to approach jurisdictional Magistrate under Section 175(3) of BNSS, 2023 in the event complaint is not transformed into FIR. In this regard, reliance is placed on judgment of the Hon’ble Supreme Court reported in (2007) 6 SCC 171 (Aleque Padamsee and others vs. Union of India and others). 4. Due to availability of alternative remedy, present writ petition is not entertained and same stands dismissed. [2] 5. However, this order shall not preclude petitioner to approach jurisdictional Magistrate in pursuit of remedy. 6.
