The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No.346/2026, registered at Police Station – Surajpur, District - Surajpur (C.G.) for the offence punishable under Sections 69, 351(2), 238, 319(2) of the Bharatiya Nyaya Sanhita, 2023 and Sections 67 and 66(C) of the Information Technology Act, 2000.

2 case, in brief, is that the applicant, a resident of Village Pimpri, District Sambhajinagar (Maharashtra), came into contact with the victim through the online mobile game Free Fire in the year 2021. It is alleged that on 08.04.2022, the applicant visited the victim's native village in Surajpur for the first time. At that time, the victim's father and brother were not at home, while her mother was asleep in another room. The applicant allegedly established physical relations with the victim on the false promise of marriage. Thereafter, he continued to visit her intermittently and maintained physical relations with her. During this period, the applicant allegedly captured her intimate photographs and videos without her consent. Subsequently, when the victim requested the applicant to marry her, he kept postponing the matter and ultimately refused. Thereafter, the victim married another person with the consent of her family. It is further alleged that, aggrieved by her marriage, the applicant threatened to upload her intimate photographs and videos on social media platforms, namely Instagram and Facebook. He also allegedly threatened to abduct the victim and cause harm to her family members if she did not comply with his demands. During the course of investigation, it was allegedly revealed that the applicant had access to the victim's Facebook account and used it to circulate her intimate photographs and videos. The investigation has been completed, the charge-sheet has already been filed, and the Applicant has been in judicial custody since

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. He further submits that the applicant has been in judicial custody since 17.07.2026. It is submitted that the applicant and the victim had known each other since 2021 and had solemnized an informal/temple marriage, thereafter living
3 together with mutual love and commitment. However, without informing or obtaining the consent of the applicant, the victim allegedly contracted another marriage with a third party. It is further submitted that no obscene material has been seized from the possession of the applicant. Moreover, the charge-sheet does not disclose whether the objectionable photographs were uploaded on Facebook by the applicant or by any other person. It is also submitted that the charge-sheet has already been filed, the applicant has no previous criminal antecedents. As the conclusion of the trial is likely to take considerable time, it is prayed that the applicant be enlarged on regular bail. 4. On the other hand, the learned State counsel opposed the bail application and submitted that the charge-sheet has already been filed. He further submitted that as per the material available on record, it reveals that the applicant established physical relations with the victim on the false promise of marriage and, after the victim married another person, allegedly uploaded her obscene photographs and videos on social media and blackmailed her, thereby tarnishing her dignity, in view of the nature and gravity of the allegations and the material available on record Accordingly, the present bail application deserves to be dismissed. 5. I have heard learned counsel for the parties and perused the documents available on record. 6. Considering the submissions advanced by learned counsel for the parties, the case diary and the material available on record and the fact that the applicant established physical relations with the victim on the false promise of marriage and, after the victim married another person, allegedly uploaded her obscene photographs and videos on social media and blackmailed her, thereby tarnishing her dignity, in view of the nature
4 and gravity of the allegations and the material available on record, this Court is not inclined to enlarge the applicant on regular bail. Accordingly, the bail application is rejected. 7.

Accordingly, the bail application of the applicant - Akshay Dilip Murhade involved in Crime No.346/2026, registered at Police Station – Surajpur, District - Surajpur (C.G.) for the offence punishable under Sections 69, 351(2), 238, 319(2) of the Bharatiya Nyaya Sanhita, 2023 and Sections 67 and 66(C) of the Information Technology Act, 2000, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
