This application under Article 227 of the Constitution of India is at the instance of the defendant nos. 2 and 3 praying for direction upon the learned Civil Judge (Junior Division), 1st Court at Barasat, to dispose of the injunction application filed in Title Suit no. 338 of 2021, expeditiously. The learned advocate appearing for the petitioners submits that the injunction application is pending for a long time. From the order sheets appended to this application, this Court finds that 3rd March, 2027 is fixed for hearing of the injunction application, acceptance of written statement with counter claim. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned Advocate for the petitioners, this civil revisional application stands disposed of by requesting the learned Civil Judge (Junior Division), 1st Court, at Barasat, to take up hearing of the application for injunction on the next date fixed i.e. 3rd
2 March, 2027, if the same is otherwise ready for hearing and make an endeavour to dispose of the same as expeditiously as possible, without granting any unnecessary adjournments to either of the parties. After disposal of the injunction application and any other interlocutory application that may be pending, the learned trial court shall make an endeavour to dispose of the suit as expeditiously as possible without granting any unnecessary adjournment to either of the parties. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities.
