2 departmental appeal dated 16/02/2026 Annexure P-1 of the petitioner.

Learned counsel for the petitioner submits that the petitioner is serving as an Inspector in the C.G. Police Department and was placed under suspension on the allegation of negligence in the investigation and challan proceedings. Learned counsel further submits that, upon conclusion of the departmental enquiry, respondent No. 3 passed the final order dated 08.01.2026, whereby the penalty of reduction of an amount equivalent to one increment was imposed upon the petitioner. Learned counsel further submits that, being aggrieved by the aforesaid
order of punishment, the petitioner preferred a departmental appeal dated 16.02.2026 before respondent No. 2, vide Annexure P-1. It is further submitted that, despite lapse of a considerable period, the said appeal has not yet been considered or decided and remains pending till date.
3. Per Contra, learned counsel for the respondents would submit that if the appeal preferred by the petitioner is still pending
consideration, the same will be decided within a period of 45 days in accordance with law.
4. I have heard learned counsel for the parties and perused the material available on record.
5. Considering the submissions advanced by learned counsel for the parties and without expressing any opinion on the merits of
3 the case, the present writ petition is disposed of with a direction to respondent No.2 to consider and decide the petitioner's departmental appeal, in accordance with law on its own merits, within a period of 45 days from the date of receipt of copy of this order. SD/-
