In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Bolpur Police Station Case No.571 of 2025 dated 12.12.2025 under Sections 126(2)/115(2)/117(2)/74/303(2)/324(4)/351(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023;
Sekh Yusuf @ Yusuf Khan @ Yusuf Mia Versus The State of West Bengal
Mr. Sanjib Kumar Dan Mr. Debapriya Samanta Mr. Akash Kumar Chakraborty. …for the petitioner.
Mr. Anurag Sardar. …for the State.
Learned advocate for the petitioner submits that the petitioner is innocent and has been falsely implicated in the instant case.
State has produced the case diary.
I have taken into account the statement of the informant/victim under Section 183 of the BNSS as well as the medical report. Although the injuries are simple in this case but a lady was physically assaulted by holding the tuft of her hair in the street when she protested for the illegal tax which was being collected at the road under the garb of toll plaza. The petitioner was the principal person who assaulted and mobilised the group of persons.

Having regard to the same, I am of the opinion that this is not a fit case for granting anticipatory bail.
Accordingly, the prayer for anticipatory bail of the petitioner in CRM(A) 991 of 2026 is dismissed.
Memo of Evidence submitted by the State be kept with the record.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
