Kausik (Allowed) CRM (A) 2007 of 2026 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Chapra Police Station Case No. 1286 of 2025 dated 09.10.2025 under Sections 323(3)/117(7)/118(2)/109/351(3)/3(5) of the BNS, 2023. And In the matter of : Archana Das ……Petitioner. Mr. Prabir Majumder Mr. Snehansu Majumder Mr. Sangeeta Chakraborty Mr. Debraj Shil Ms. Anindita Kundu ……for the Petitioner. Mr. Sunil Gupta ….for the State. Learned advocate appearing for the petitioner submits that the main accusation is against the husband of the present petitioner and petitioner has been implicated as she was present at the time of alleged offence. Learned advocate for the State has referred to the injury report. I find from the injury report that there is a wound of about 8 cm in length at the chest of the injured. However, the statement of the injured under Section 183 of the BNSS reflects 2 that such injury allegedly was committed by the husband of the present petitioner when the petitioner was physically present. Having considered the fact that charge sheet has already been submitted, I am of the opinion that custodial detention of the present petitioner at this stage, is unwarranted. As such, prayer for bail anticipatory bail is allowed. As such, I direct that in the event of arrest, the petitioner namely, Archana Das be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the charge sheet has already been submitted, this order of anticipatory bail will remain in force for a period of 6 weeks from date. Accordingly, CRM (A) 2007 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
