A perusal of the judgment passed by the learned Trial Court shows that the cheque was issued in the name of Jatinder Singh, whereas the complaint was .led by Jitender Singh. There was a discrepancy regarding the Bank before which the cheque was presented. These aspects require further consideration. In view of the above and keeping in view the nature of the o0ence punishable under Section 138 of NI Act, execution and operation of the substantive sentence of imprisonment awarded by the learned Trial Court on 25.2.2023/7.3.2023, as a7rmed by the learned Appellate Court on 29.11.2025, in Criminal Appeal No. 58 of 2023 is ordered to be suspended, subject to furnishing of personal and surety bonds in the sum of ₹25,000/- each to the satisfaction of the learned Trial Court. The bail bonds, so furnished by the applicant/petitioner be transmitted to this Court for placing the same on record. A copy of this order be sent to the learned Trial Court for information.
