Heard.
2. The petitioner has approached to this Court with the following prayers :
“1. Hold and declare that the deliberate failure and inaction on the part of Respondent Nos.1 to 5 in not issuing the formal Work Order to the Petitioner for the work of "Development of Modern Office for Agricultural Department, Washim" (Item No.6), despite the official allotment via "Ishawar Chithi" (Chit Draw) dated 25/03/2026, is manifestly arbitrary, illegal, unjust, and violative of Articles 14 and 19(1)(g) of the Constitution of India;
2. Hold and declare that the communication dated 21/07/2026 issued by Respondent No.1 citing unavailability of funds is illegal, bad in law, and arbitrary, Prity 2026:BHC-NAG:10996-DB
2 / 3 103.wp6481.2026 and accordingly issue a Writ of Certiorari or any other appropriate writ, order, or direction quashing and setting aside the same.
3. Hold and declare that, the petitioner is entitled for the work which was issued to the petitioner in "Ishwar Chithi" (Chit Draw) thereafter and it is illegally, arbitrarily assigned to some other person without cancelling the tender issued in the form of "Ishwar chithi"(Chit draw) and without communication and issuance of work order.
4. Issue a Writ of Mandamus or any other appropriate writ, order, or direction commanding Respondent Nos.1 to 5 to immediately issue the formal Work Order in favor of the Petitioner for the work of "Development of Modern Office for Agricultural Department, Washim" (Item No.6) pursuant to the allotment letter dated 25/03/2026;
5. Issue a Writ of Certiorari or any other appropriate writ,
order, or direction calling for the records and quashing the communication dated 21/07/2026 issued by Respondent No. 1 as illegal and arbitrary.
6. Direct Respondent Nos.1 to 5 to initiate an inquiry against the unauthorized execution of work by Respondent No. 6 and restrain Respondent No. 6 from interfering with or executing the allotted work.
7. Stay the work committee meeting no. 2 (2026-2027) and further allocation work without giving opportunity to the petitioner as mentioned in Annexure 10.
8. Grant interim relief directing Respondent Nos.1 to 5 not to award or process the work order for Item No. 6 to any third party during the pendency of this Writ Petition.
9. Pass such further order or orders as this Hon'ble Court may deem fit and proper in the interest of justice.” Prity

3. We are of the opinion that the purpose would be served if the respondent No.1 is directed to consider the present petition as a representation of the petitioner and take a decision thereon within a period of two weeks from today.
4. Accordingly, the writ petition is disposed of with direction to the respondent No.1 to treat the present petition as a representation and take decision on the same within a period of two weeks from today.
5. The decision taken thereon shall be communicated to the petitioner within a period of one week thereafter.
6. The respondent No.1, if deems it necessary, shall grant hearing to the petitioner.
7. The petitioner undertakes to furnish the copy of this order on or before 25.08.2026 to the respondent No.1.
