Wasim Akram … for the Petitioner(s) Mr. Gourangya Kr. Das, APP Mr. Amal Kumar Datta … for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is innocent of the charges and has been falsely implicated in connection with the instant case. Learned advocate also submits that the return of the medicine/cough syrup has been prayed for by a different person. As such, learned advocate prays that the petitioner may be enlarged on bail on any stringent condition. Mr. Gourangya Kumar Das, ld. APP, appears for the State along with a junior of his choice as per the direction of this court. The appointment of both Mr. Das and the junior of his choice, if any, be regularized by the concerned authority. Learned advocate for the State opposes the prayer for bail and submits that there are Call Data Records 2 reflecting the communication between the present petitioner and the other accused. However, the issues canvassed being the question of facts, be addressed at the time of trial. Having considered that the rigors of Section 37 of the NDPS Act is attracted, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (NDPS) 1061 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record.
