13.08.2026 IN THE HIGH COURT AT CALCUTTA Item No.44 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. Rejected C.R.M. (M) 939 of 2026 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Sutahata Police Station Case No. 407 of 2024 dated 07.12.2024 under Section 103(1) of the Bharatiya Nyaya Sanhita, 2023. And In Re : Anita Das ... Petitioner. Mr. Suman De ... For the Petitioner. Mr. Amal Kumar Datta ... For the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 1 year 8 months and out of 18 witnesses cited by the prosecution, only 2 witnesses have been examined. There are medical issues of the present petitioner. As such, petitioner prays for bail on any stringent condition. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and produces the case diary. I have taken into account the factual foundation of the case of the prosecution which relates to tying an old lady pouring kerosene and setting her on fire. The post mortem report, prima facie, do corroborate such issues. Having regard to the heinousness of the offence, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected. 2 Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (M) 939 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
