Ali, learned counsel appearing for the accused petitioners as Page No.# 2/3 well as Mr. P. Borthakur, learned Addl. P.P., Assam appearing for the State respondent. 2. This petition under Section 483 of the BNSS, 2023 has been filed by the accused-petitioners, namely, Ajibar Rahman @ Ajibor Rahman and Sohidul Islam @ Saidul Islam, praying for grant of bail in connection with Bilasipara P.S. Case No.391/2025 under Sections 103(1) BNS 2023. They were arrested on 22-01-2026. 3. On 19-12-2025, the father of the deceased lodged an FIR alleging that his 17 year son had gone to a religious meeting on the previous evening and upon returning back, he did not find him at home. Later on, his brother-in-law found his dead body in a nearby jungle and several injuries were found on his body. 4. No one is named in the FIR. The present accused persons were arrested during the investigation. The grounds of arrest mentions about their involvement in the alleged incident of killing of the victim. 5. It is submitted by the learned counsel for the petitioners that they deny any involvement in the alleged incident and that they have already spent 68 days in custody. Drawing attention to Para 6 of the bail petition it is contended that the victim had a love affair with daughter of one Maidan Ali but she was already married to another boy and in connection with the same there was some enmity between the victim and family members of the girl and petitioners have been falsely roped in. 6. The case diary has been received. 7. The learned Additional Public Prosecutor submits that it has emerged from the statements of several witnesses that the victim and the daughter of one of the accused persons was having a love affair and on the day of the incident having come out from a religious congregation they found both of them in a compromising position. Thereafter, he is suspected to have been assaulted and Page No.# 3/3 killed. 8. The learned Additional Public Prosecutor fairly submits that the witnesses have stated about their strong suspicion regarding the involvement of the accused persons. 9. I have also perused the bail objection submitted by the IO. 10. The post-mortem report is available but opinion regarding death is not finalized as the FSL report is awaited. The post-mortem report indicates several injuries on the dead body of the deceased. It is stated and contended in the bail objection that investigation is at a crucial stage. 11. I have given my consideration to the matter. In the given facts and circumstances, the instant bail petition stands rejected at this stage. 12.
