Learned advocate appearing for the petitioner submits that the subject matter of alleged recovery of 103 bottles of phensydyl from the possession of the co-accused. Petitioner has been implicated on the basis of the co-accused and there has been no seizure from the present petitioner. Learned advocate appearing for the State opposes the prayer for bail and submits that huge number of communications are available between the petitioner and the other accused. Charge sheet has been submitted and the charges have been framed. Having considered the subject matter of the present case and the petitioner being in custody for about five and half months, I am inclined to release the petitioner on bail. Thus, prayer for bail of the petitioner is allowed.

Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of learned Judge, NDPS Act, 3rd Court, Balurghat, Dakshin Dinajpur. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District Dakshin Dinajpur without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 1037 of 2026 is allowed. Memo of evidence filed by the State is taken on record. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
