The counsel for the petitioners contend that the petitioners have been falsely implicated in the present case. The present dispute stems out of a relationship between the petitioner-Satnam Singh and complainant-Jaspreet Kaur. Petitioner-Satnam Singh has been granted the pre-arrest bail in FIR No.11 dated 10.01.2021. As the petitioners are in custody since 06.05.2026 but after VISHAL SETHI 2026.07.22 17:55 I attest to the accuracy and integrity of this document CRM-M-28780-2026 & another case 6 the filing of the challan, none of the 14 prosecution witnesses has been examined so far, the Trial of the present case is not likely to be concluded anytime soon and therefore, they are entitled to the concession of bail particularly when all the offences are minor in nature other than Section 379- B. 5. The complainant, who is present in the Court, on the other hand, contends that initially an FIR No.11 dated 10.01.2021 under Section 376 and 420 IPC was registered at her instance against Satnam Singh with whom she was in a relationship. There were multiple pieces of evidence available in her phone regarding the said relationship. That phone along with her gold chain has been taken away during the present occurrence. She has been beaten up mercilessly. The Investigating Agency in connivance with the petitioners has submitted an incomplete challan. Therefore, the petitioners be not granted the concession of bail till the complete challan is filed. 6. The learned counsel for the State, on instructions from ASI Gurmail Singh, contends that initially the Investigating Agency had prepared a cancellation report. Later, the case was referred to the Bureau of Investigation that recommended action to be taken against the petitioners and their co-accused. In furtherance of the said investigation, the petitioners were arrested. The challan stands filed and no further investigation is pending except against those persons who have not yet been arrested. He admits that VISHAL SETHI 2026.07.22 17:55 I attest to the accuracy and integrity of this document CRM-M-28780-2026 & another case 7 though the challan stands filed, none of the prosecution witnesses has been examined so far. He also admits that the petitioners are in custody since 06.05.2026. 7. I have heard the learned counsel for the parties. 8. The veracity of the prosecution case against the petitioners shall be adjudicated upon during the course of the Trial. Admittedly, the petitioners are in custody since 06.05.2026. However, none of the 14 prosecution witnesses has been examined so far. Therefore, the Trial is not likely to be concluded anytime soon. The investigation is complete qua the petitioners. All the offences other than Section 379-B are minor in nature. In this situation, the further incarceration of the petitioners is not required. 9. Thus without commenting on the merits of the case, the present petitions are allowed and the petitioners Satnam Singh, Inder Rajput and Komal @ Komal Rani are ordered to be released on bail subject to their furnishing bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate, concerned. 10. The petitioners shall appear before the police station concerned on the first Monday of every month till the conclusion of the trial and inform in writing each time that they are not involved in any other case/crime other than the case(s) referred to in this order. 11. If any attempt whatsoever is made by the petitioners and/or their family members/friends to contact/threaten/intimidate any of the witnesses of VISHAL SETHI 2026.07.22 17:55 I attest to the accuracy and integrity of this document CRM-M-28780-2026 & another case 8 the present occurrence, the State/complainant shall be at liberty to move an application for cancellation of bail granted vide this order. 12. In addition, the petitioners (or anyone on their behalf) shall prepare an FDR in the sum of Rs.1,00,000/- each and deposit the same with the Trial Court. The same would be liable to be forfeited as per law in case of the absence of the petitioners from Trial without sufficient cause. 13. The Commissioner of Police, Ludhiana is directed to ensure the protection of the life, liberty and property of the complainant. 14. The petitions stands disposed of. 15.
