1. The review petitioner has filed an application ‒ I.A No.1/2025 seeking condonation of delay of 234 days in filing the review petition. 2. The learned Government Advocate appearing for the respondents does not contest the review petitioner's request for condonation of delay. Accordingly, the same is allowed. 3. The review petitioner has filed the present petition seeking review of the judgment dated 18.02.2025 passed in Writ Petition No.26018/2024 (GM-MM-S). 4. The learned Senior Counsel appearing for the review petitioner submits that the arguments were heard and the order was reserved on 19.11.2024 but, was pronounced on 18.02.2025. In the meanwhile, on 17.02.2025, the prayer regarding transfer of

the forest clearance was rendered infructuous as the said approval was granted. 5. It is apposite to set out the prayers made in the writ petition. "a) Issue a writ in the nature of certiorari and set aside the impugned Stoppage Notice bearing No.A3/Minera/CR-21/2023-24 dated 08.04.2024 issued by the Fifth Respondent vide Annexure 'N', in the interest of justice and equity;
b) Issue a writ in the nature of mandamus directing the respondent Authorities to expedite the process for transfer of the FC and other applicable approvals in favour of the petitioner in terms of Sec.8B of the MMDR Act read with Rule 9A of the MCR 2016 as amended in 2021, in the interest of justice and equity."

As is apparent from the above, one of the prayers made by the review petitioner was to expedite the process for transfer of forest clearance, which we are informed was granted on 17.02.2025, and to this extent, there is merit in the contention that one of the prayers did not survive. 7. Having stated the above, we also find merit in the respondents' contention that the judgment merely sets down the position of law and therefore, it is not required to be reviewed. - 5 -

The learned Senior Counsel appearing for the review petitioner submits that the principal apprehension in the mind of the review petitioner is that the impugned judgment may be read at a subsequent stage as raising a question on the transfer of the forest clearance. To this extent, the learned Government Advocate submits that the clearance already granted will not be questioned solely on the ground that the judgment had been rendered after the clearance had been granted. 9. In view of the said unequivocal statement made by the learned Government Advocate, the review petitioner cannot harbour any reservation.
