By the present writ petition, the petitioner seeks quashment of the impugned order dated 11.03.2026 (Annexure P/1), whereby his representation seeking implementation of the transfer order dated 07.05.2025 has been rejected, and further seeks a direction to the respondent authorities to relieve him from Kawardha Division and permit him to join at his transferred place of posting.

Learned counsel for the petitioner submits that the petitioner has been working as a Land-Displaced Line Operator (Contractual) at Rampur Distribution Centre, Kawardha Division, since
13.10.2016. He submits that on account of family difficulties and the medical condition of his old age parents residing in District Janjgir-Champa, the petitioner sought transfer and, pursuant thereto, vide order dated 07.05.2025, the competent authority transferred him from Kawardha Division to Champa Division. However, despite the said order remaining operative, the petitioner was not relieved. He further submits that the petitioner
3 has earlier preferred a writ petitioner bearing W.P.(S) No.793/2026, wherein this Court vide order dated 23.01.2026
directed the concerned respondent authorities to consider the petitioner’s representation regarding implementation of the transfer order, but the same has been rejected vide the impugned
order on the ground of shortage of staff at Kawardha Division.
Learned counsel further contends that the competent authority having already passed the transfer order, the petitioner cannot be denied relieving by an authority subordinate to it on the ground of administrative exigency. It is, therefore, prayed that the impugned
order be quashed and the petitioner be relieved pursuant to the transfer order dated 07.05.2025.

On the other hand, learned counsel appearing for the respondents opposes the submissions made by the petitioner and submits that the earlier writ petition was disposed of with a direction to consider the petitioner’s representation and, pursuant thereto, the same has been duly considered and rejected on account of insufficient staff at Kawardha Division. It is, therefore, submitted that no interference is warranted with the impugned order.
4. I have heard learned counsel for the parties and perused the documents available on record.
5. From perusal of the record, it is not in dispute that the competent authority passed the transfer order dated 07.05.2025 transferring the petitioner from Kawardha Division to Champa Division. It is
4 also not in dispute that the said transfer order has neither been cancelled nor modified by the competent authority till date. The subsequent rejection of the petitioner’s representation on the ground of shortage of staff, therefore, cannot, by itself, render the subsisting transfer order ineffective, particularly when the transfer had already been ordered by the competent authority.

In view of the above, and considering the fact that the petitioner’s transfer was ordered by the competent authority on his request, inter alia, on account of his family circumstances and the medical condition of his old age parents, the impugned order dated 11.03.2026 (Annexure P/1) is hereby set aside. The respondent authorities are directed to relieve the petitioner and permit him to join at his transferred place of posting pursuant to the transfer
order dated 07.05.2025, expeditiously, preferably within a period of 10 days from the date of receipt of a copy of this order. However, liberty is reserved in favour of the respondent authorities to pass an appropriate order afresh, in accordance with law, if so advised.
7. In the result, the Writ Petition is allowed to the extent indicate above. Sd/-
