1. It is submitted by learned counsel appearing on behalf of the petitioner that the petitioner is innocent and he has been falsely implicated in the case on the basis of the co- accused statement. No recovery has been made from him. He has been acquitted in NDPS case no. 55/2020 (Special Case no. No. 55/2020). He prays for anticipatory bail on any terms and conditions.
2. Learned counsel appearing on behalf of the State produces the case diary as well as the memo of evidence and opposes the prayer for anticipatory bail of the present petitioner on the ground that there are previous antecedents of the similar nature of offences.

3. Memo of evidence, filed by the State, is taken on record.
4. Having heard the learned counsels for the respective parties and on perusal of the case diary produced by the State, it is revealed that he has two previous antecedents viz. 1. Kaliachak PS Case No. 366/2020 dated 09.05.2020 u/s 21(c)/29 of NDPS Act and 2. Kaliachak PS Case No. 779/2020 dated 08.10.2020 u/s 25/25(A)/27(A)/29 of NDPS Act r/w Section 27 of the Drugs and Cosmetics Act, 1940. Therefore, this court is not inclined to grant anticipatory bail to the present petitioner.
5. Accordingly, the prayer for anticipatory bail of the present petitioner is rejected.

7. Concerned Department is directed to supply certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities. ( Ajay Kumar Gupta, J. )
